City’s Fight with the Sewer District to Go to Trial

The city’s case against the Northeast Ohio Regional Sewer District will go to trial in October, said. 

Brecksville is one of a number of communities fighting the sewer district’s proposed stormwater management fees. If passed, residents would see higher bills. 

The district wants to take more control over stormwater management, the manager of watershed programs for the district . But the city has been doing a good job of independently handling the problems associated with stormwater, then-law director Paul A. Grau said. 

County administrators and the cities have been trying to reach an agreement through mediation, but Matty said nothing came of that. The trial had originally been scheduled to begin next week, but the judge pushed it back to Oct. 31. Matty said that date is set, barring extreme circumstances, and they have been asked to set aside three weeks for a trial.

Matty said he will be representing Brecksville in the case. The other cities’ law directors will also be present, and they have a lead counsel to oversee all parties.
